Bustos to accept Powhatan BOS offer, some residents outraged

No one has been officially appointed to fill the now-vacant District Two seat on the Powhatan Board of Supervisors, but BOS Chairman Bob Cosby said the board has entered into negotiations with Marsell Bustos.

Bustos is expected to be publicly appointed District Two Interim Supervisor at the board’s October 14 meeting, but some Powhatan County residents are upset because the process of choosing Charlie Green’s replacement was not done publicly.

The District Two position was left open after Mr. Green died October 2.

Bustos said October 13 he will “absolutely” accept the board’s offer.

The BOS reportedly chose Bustos after it went into closed session at a meeting October 7 labelled “Board of Supervisors Special Meeting” on the Powhatan County website.

Jason Moore, a Powhatan-based attorney and resident of District Two, said he is “very disappointed” with the selection process and feels “disenfranchised” as a resident of that district.

“This is a closed system with no transparency.”

Moore said the board should have requested resumes from candidates and conducted a public interview and voting process.

According to Virginia State Code, the BOS has 45 days to select a resident to serve as interim supervisor. If no action is taken within that time, the Circuit Court would step in to fill the hole.

Cosby said Bustos will only serve as interim supervisor until a District Two general election can be held 12 months from now.

There was not sufficient time under Virginia Law- 120 days according to the code- between Mr. Green’s passing and the November election period to hold a public vote. 

District One Supervisor Joe Walton said “[There’s] no good way to poll District Two in 45 days in any fair way. You can’t have an election in 45 days.”

“Faced with trying to approximate democracy,” Walton said the board considered Mr.Green’s thoughts and feelings before he died and “tried to do what Charlie [Green] would have wanted.”

Asked about the selection, supervisors also noted Bustos was the runner up to Mr. Green in the District Two election two years ago.

One resident, who asked not to be identified, complained the board’s approach “May be legal, but it flies in the face of good governance…” and “bring[s] Chicago-style politics to Powhatan.”

And Moore takes exception to what he says were beauty-contest rules for selecting an interim supervisor and said Bustos only took second place by 16 votes in the District Two election.

Moore said he will ask the board to open the process at its October 14 meeting; to conduct a selection process he said should be similar to the way The City of Richmond and Chesterfield County handled replacing board members in the past.

He added that Bustos should not accept the board’s offer because of its handling of the selection process.

Bustos said October 13 he intended to accept the boards offer. “I would rather let this pass tomorrow and discuss it Thursday. I understand both sides,” but he said answering questions ahead of the October 14 supervisors’ meeting would be disruptive. 

Cosby said the board’s decision was made “the way we thought it ought to be done.” He stressed that Bustos would only serve “about a 12 month appointment. Not even to fill out” the two years remaining on Mr. Green’s unexpired term.

A special election will be held in November 2010 to fill the Second District seat by popular vote and Cosby said residents should know candidates for supervisor must be qualified voters and residents of the district they represent.

To add to Ms. McKerney’s point

Mr. Bustos (as a recall from Powhatan Today doing a profile on him before the election) is a former Navy LCDR.

That being the case, he of all people should know that he is responsible for the material and actions of those under his command, or less stated, those under the umbrella of his leadership as a basic leadership function. Clearly that lesson has not been lost ?

I’m actually surprised you Dems actually put a military guy as your chair to begin with, considering your admitted “radical” views and repeated, obvious disdain for all things military.

Let’s not mince facts.  Greg Ownby was the Chair of the Dem. Party when their blog posted the photos of 3 of our School Board members, above and below nasty name calling and the nasty comments that followed.  A week later, it was announced that Mr. Bustos was the new Dem. Party Chair. 

No one EVER accused Mr. Bustos of writing the blogs. He is being held accountable as the CHAIR of HIS local party. His accountability began when he stepped into the position.

I spoke to him last night and he never once stated he ‘did not have access’ to his own party website, and how ridiculous of a comment would that be?  In the ensuing month, he could and should have insisted that the ‘filthy Republican’ blog be removed and he could have and should have issued an apology to both the school board members and all of Powhatan’s filthy Republicans…which is about 80% of the county voters! He can still do this!  This is what a leader of HIS/HER Party does. Instead, not only did this not happen until yesterday…a healthcare cartoon was added that poked fun of those who pray to God. One has to wonder:  what does he REALLY think of Powhatan’s school board members, of the majority of Powhatan families and of prayer/God?
Most people stand up for what they believe in. 

You admit your blog writer is a bit ‘radical’ but instead of holding him accountable for persecuting local elected officials and an entire party of people…you are disgruntled and disgusted because you felt forced to take the site down? How typical. Sad the party didn’t feel compelled to take it down on the grounds that it was hateful and just simply wrong.  By the way, Mr. Bustos did not give that as the reason it was taken down…you might want to get your stories straight.

T.J., If I allow a public website of a local organization that I am Chair or President of, to contain egregious name calling and bashing of an individual or an entire class of people to remain posted while I sit back silently….I am counting on you to hold me accountable.

If I am too busy, unconcerned, incompetent or anything else (besides in the midst of a catastrophic situation), I am unqualified to be in a leadership role.

All I can say is that since the Board unanimously appointed Mr. Bustos to the Board and since there is AT LEAST one Republican out of the four on the Board, then they are making the best decision collectively in their judgment.  This is how representative democracy works- we chose the Board in 2007 to make tough decisions, they are making those decisions as we speak.  We can hold each member of the Board accountable in 2011 when their terms are up and we choose new supervisors.  We are not a direct democracy where every citizens gets to vote on every decision.  Like it or not, they have been elected by the people to run the Powhatan government.

Thank you for making it clear Carolyn Cios had no decision in the choice of Mr. Busto.  In my opinion Carolyn has done a teriffic job as County Administrator. The Board explained their decision and maybe everyone didn’t agree, but let’s try to all make Powhatan a better place to live.  Attend meetings, get involved and take part in our County. Please don’t let this WalMart thing divide our County.  We elected them, now let them do their job.

I have not read all of the comments here, but I can understand why many would be upset.  I say if Jean will do it, she is the best choice, then hold a special election at a later date.  At least she knows her husbands philosophy and how he did things.  It does not matter if Mr. Bustos lost by 16 votes or by one.  He lost the election.  I think the issue is that he did lose the election.  I for one don’t see ANYONE able to fill Mr. Green’s shoes but if I lived there, Mrs Green would get my vote.  Isn’t this how vacancies in even senate positions are sometimes filled in circumstances like this?  As for me, Mr. Green was one whom I believed would not have been up for any and all big business to come here, he would have thought long and hard about his decisions concerning any change in this county that he loved.  He was one of a kind.

The entire blog has been shut down due to it being used against Mr. Bustos. Our freedom of speach has been taken away by those who would use the words of one person against another. We did this for Mr. Bustos because he is a wonderful man who served his country and is now ready to serve our county.

I am not any of those people,if anyone is sounding childish it is you. now that we have that settled- Your own words from facebook make it sound partasan-
“Darrell Griffin How can the board in good conscience fill this position with the loser from the previous election ? How can the board fill this position with someone who’s party and ideas have been soudly (by large mnargins) rejected time and time again by the constituents of the district he would represent ?”
Do you even know Mr. Bustos? He has been working hard for district 2 working with Charlie Green.

Jason Moore who has not done much for the kids as a memeber of the School Board, spoke out against members of the BOS for wanting a better working relationship with the School Board is now speaking out against Mr.Bustos-I have it from a good source that it is because he wanted to go for the apointment. As for all the closed door stuff and them moveing fast- there is a big issue on the door- Wal-Mart and from what i understand the way they made thier apointment is the same way most apointments are made- the public comments come once the apointee is named- well he is named and you are commenting!

Todd, I’m confused. I’ve been looking for offensive posts on their official website, but I can’t find any. The blog appears to have been hacked. I’ve been reading both the official site and the blog for a couple of years and I don’t recall one post by Bustos. Regardless, if Bob McDonnell can’t control the opinions of others, is it reasonable to expect you, or Lisa, or anyone to control someone else’s opinion? I’ve been reading yours all day, and I must say you have quite a few. “Bornhere” said some disparaging things earlier, probably in the heat of strong, deeply felt emotions. Limbaugh, Hannity, you, Frum, you all have an opinion, right or wrong, good or bad. I’m sure if you asked Bustos his opinion on any given topic, he’d give you an intelligent, well-informed, well-MANNERED response free of anything filthy or offensive. Anyone who values making an informed decision would start there, I would think, before passing judgment based on someone else’s blowhard opinion.

Your verbage, tone and demeanor tell the tale that you are the same person or group of persons, going back to the same irrelevant, silly talking points and ignoring the larger issue which has been articulated fairly well here…...by comparison, you have made none other than it’s a partisan issue.
Who is it that posted they wanted to run, or were defeated and are mad now ? I have read all the posts on both threads and cannot find who(m) you are referring to. PErhaps oh wise one you can enlighten us and name names . Time and again you characterize people who object as bitter,partisan or whatever and completely ignore the valid arguments in favor of personal attacks.
You who accuse everyone of childish or temper tantrum behavior really need to take a look in the mirror and mentally graduate from Jr. High and all the “you are just mad cuz you lost…” silliness.
Seriously, who and what was said for you to make your latest point ? Go back to your blogosphere and seminar writing (of which your language skills are lacking) and leave the conversation to mental adults. OK pumpkin ? Bye now
