Bustos to accept Powhatan BOS offer, some residents outraged Published: October 13, 2009 By Michael Copley No one has been officially appointed to fill the now-vacant District Two seat on the Powhatan Board of Supervisors, but BOS Chairman Bob Cosby said the board has entered into negotiations with Marsell Bustos. Bustos is expected to be publicly appointed District Two Interim Supervisor at the board’s October 14 meeting, but some Powhatan County residents are upset because the process of choosing Charlie Green’s replacement was not done publicly. The District Two position was left open after Mr. Green died October 2. Bustos said October 13 he will “absolutely” accept the board’s offer. The BOS reportedly chose Bustos after it went into closed session at a meeting October 7 labelled “Board of Supervisors Special Meeting” on the Powhatan County website. Jason Moore, a Powhatan-based attorney and resident of District Two, said he is “very disappointed” with the selection process and feels “disenfranchised” as a resident of that district. “This is a closed system with no transparency.” Moore said the board should have requested resumes from candidates and conducted a public interview and voting process. According to Virginia State Code, the BOS has 45 days to select a resident to serve as interim supervisor. If no action is taken within that time, the Circuit Court would step in to fill the hole. Cosby said Bustos will only serve as interim supervisor until a District Two general election can be held 12 months from now. There was not sufficient time under Virginia Law- 120 days according to the code- between Mr. Green’s passing and the November election period to hold a public vote. District One Supervisor Joe Walton said “[There’s] no good way to poll District Two in 45 days in any fair way. You can’t have an election in 45 days.” “Faced with trying to approximate democracy,” Walton said the board considered Mr.Green’s thoughts and feelings before he died and “tried to do what Charlie [Green] would have wanted.” Asked about the selection, supervisors also noted Bustos was the runner up to Mr. Green in the District Two election two years ago. One resident, who asked not to be identified, complained the board’s approach “May be legal, but it flies in the face of good governance…” and “bring[s] Chicago-style politics to Powhatan.” And Moore takes exception to what he says were beauty-contest rules for selecting an interim supervisor and said Bustos only took second place by 16 votes in the District Two election. Moore said he will ask the board to open the process at its October 14 meeting; to conduct a selection process he said should be similar to the way The City of Richmond and Chesterfield County handled replacing board members in the past. He added that Bustos should not accept the board’s offer because of its handling of the selection process. Bustos said October 13 he intended to accept the boards offer. “I would rather let this pass tomorrow and discuss it Thursday. I understand both sides,” but he said answering questions ahead of the October 14 supervisors’ meeting would be disruptive. Cosby said the board’s decision was made “the way we thought it ought to be done.” He stressed that Bustos would only serve “about a 12 month appointment. Not even to fill out” the two years remaining on Mr. Green’s unexpired term. A special election will be held in November 2010 to fill the Second District seat by popular vote and Cosby said residents should know candidates for supervisor must be qualified voters and residents of the district they represent.

excuse me bornhere but Marsell had nothing to do with the blog-he had just become chair and did not have access to it yet- infact Greg Ownby was first blamed for it and when the person responsible for it was asked to take it down he did. Yes that person is a bit radical but so is Rush and Glenn Beck! As for Mr. Green not approving of Marsell- he apointed him to the Trasportation Committee! His Wife is very happy with Marsell as his replacement, if you know them so well call her and ask her!! Darrell Griffin

in regards to what “disapointed” said- Mr. Bustos did convey to the board that if it were a choice between running in 2010 and being apointed he would rather run in 2010 because he is dedicated to this county for the long run, the board in turn offered him both the apointment and to run. I do not believe leagally they can stop anyone they appoint from runing so they could appoint someone else but only have thier word that they would not run- if Mr. Bustos does not do the Job to the satisfaction of District 2 then they can not vote for him in 2010. I also find it intersting that one of the people speaking out against him is only doing so because even after writing a scathing letter against the board has now made it known that he wanted a chance to be on it! One of the others heading up the oposition is still mad that they lost the election to the post they wanted- they however have not been involved in the county like Mr. Bustos- have they been to planning meetings, board meeetings, transpertation meetings? the answer is a big fat NO! Bob McDonnell is a sharp guy with great ideas who desires to do positive things for the state of Virginia, but I can’t support him because of nasty, unapologetic right wing commentators like Rush Limbaugh, Sean Hannity, Glenn Beck, and Ann Coulter. They constantly belittle Democratic politicians, calling them names and holding them up to ridicule. Not ONCE have I heard Bob McDonnell denounce these commentators, so I have to assume he shares their opinions on everything. Makes sense, huh? Todd Rojcewicz of Powhatan

Struggling small Businesowner, Mr Bustos was the runner up. agreed. 71% of the voters did not vote for him. That aside, All I ask is an open, transparent, ethical process. If a process is carried out with other intrested citizens having the opportunity to throw their name in the ring, and Marsel is the best person to appoint, then we ALL will wish him well. The BOS says ” this is legal” Ok.. thats the last defense of a scoundrel. Struggling Small Businessowner

I would like to show my support for a very qualified and intelligent candidate is available and willing to fill Charlie Green’s seat on the Board of Supervisors. Marsell Bustos has the leadership skills, the dedication, and the interest in the county to become a true asset to the Board and to Powhatan. It should also be noted that Marsell was the runner-up in the district election which should show that his constituents think a lot of him as well. Marsell will represent District 2 first and will be completely non-partisan. I also agree with one writer who posted that if Marsell had been a Republican, there would NOT have been any type of discussion or controversy. People who say it isn’t a partisan discussion isn’t being honest with themselves. Confused & Concerned of Powhatan

If Mr. Busto is affiliated with the Powhatan Dem Party and he is, and the article appeared about “filthy” Republicans, why didn’t he distance himself at that point or insist that it be removed? Sounds like someone else in the public, don’t tell me that Busto didn’t know that was on the Dem website! Shame on you Mr. Busto. Shame on the BOS for trying to ram this down our throats…like it or not! Sounds like a good segment for Fox News! Darrell Griffin

Civics Nerd: Please do not speak for me. I am absolutey voicing my concern for the principle of how this is being handled. I have called each BOS personally to inquire and to express my concern. I give credit that they have all returned my call. I also give credit that they have now put public comment on the agenda BEORE they annonce a decision. I will be the first to give credit where it is due. You state: “Also, Mr. Bustos did not write the Dem blog entry, so why is he being criticized for it? He has only been the Democratic Party chair for a few months.” Are you kidding? You don’t have to be a chair to know it’s wrong to call an entire group of people ‘filthy’ on what is suppose to be a website that represents a party. You don’t have to be a chair to know it’s wrong to persecute elected officials, with their photos posted above and below nasty names. BUT if per chance you ARE the chair and for two months you allowed such trash to remain on your party site that you are responsible for….you have no place being a leader. Especially of the very people you allowed to be trashed and the very elected officials that you intend to work with. And then there was the trashing of prayer. Need I say more?
