First public meeting on apartments deferred Published: September 14, 2011 By Roslyn Ryan Opponents of a plan to build an apartment and townhouse complex near the site of a planned Walmart will have to wait another month to hear the county Planning Commission’s discussion of the matter. The issue, which was originally set to be discussed at the Sept. 6 Planning Commission meeting, has been deferred until the October meeting at the applicant’s request. According to County Planning Director Brandon Stidham, an applicant can request a deferral from county staff provided the case has not yet been advertised. The delay in taking up the matter publicly did not stop a large group of county residents from attending a meeting held last Wednesday at Rosa’s restaurant near Flat Rock to express their own views. “We had a full house and a ton of positive input to such a negative subject,” said Powhatan resident Kip Williams in an e-mail received by Powhatan Today. “We all agreed that there are hundreds of reasons not to put these apartments in this location but we could not find any positive reasons to locate these apartments on Stavemill Road.” The planned development, which drew criticism from residents almost as soon as it was announced, actually involves two cases. The first case seeks a rezoning of the property from R2, which stipulates no more than one home per four acres, to a Residential Utility classification. This would allow for as many as four dwellings per one acre. The second case that will go before the commission in October will be for a conditional use permit. Stidham explained that this would be required in order to place townhouses and apartments on the site. |

You can sue anybody for anything, but I think that if the County were to deny the rezoning, it would be highly unlikely that the developer could sue the County and win. Darrell G

Mr Reality, If they DO allow this rezoning, then they can’t deny the CUP without opening themselves to a lawsuit. If they allow the rezoning and then try to deny others that are similar, you can bank on there being lawsuits. Talk about opening the floodgates….....the new Comp Plan and the zoning in it will be worthless. I’m no attorney, but it seems that if the Comp Plan and current zoning don’t allow for it, they have a weak basis for suit to make the board rezone it. If it’s already zoned a certain way, there’s not a heck of a lot that they can do about stopping it. This is why the rezoning of the property is more important than anything else. Here’s my take on the proposed apartments: The BOS will base their decision on whether they want to deal with a lawsuit from the developers or face the losing economic proposition of providing services for the occupants of the apartments. I have no facts to base this on. Just my gut feeling as a long-time observer. jj of Here

How many of you will be willing to pay for another Bond or a tax raise, when our schools become overcrowded because of the children these apartments would draw into the county. Our schools are at the max now - in size and money. Darrell G

PowhaCoward, Once again, you show your ignorance. There is a pending action by the BoS to include the area in the W & S service area. Generally speaking, if the area is included, the cost of connection goes to the county. If it is outside, it goes to the developer. That’s a significant expense, and it appears crony capitalism is going to shift that burden to the taxpayer. Yeah Balzer is laughing at us all right. If you see the proffers as origionally started and how they have been whittled down, you would think the county was negotiating from a position of weakness. Second, the Eastern Corridor W & S receives around 550,00 GPD from Chesterfield. Consumption by the complex is important, because once that GPD is near or exceeded you have to secure new sources….meaning more $$$$ for infrastructure and product. You can have all the pipes in the world, it does no good if there is no H2O to send through it. This in a W & S system that is already being subsidized by the taxpayer and has had significant cost overruns and 2 catastrophic failures w/in 7 years. Third, who will have the cost of routing the power lines ? The county, Va Power, or the developer ? You can’t just tap off a few side circuits, you have to add a few transformers and other items. The lines have to be able to accomodate the load. You don’t just build a complex and all the infrastructure needs magically appear. It isn’t Sim City. There are significant costs to tie it all in and service it. Who the cost burden falls to is very important. If the taxpayer assumes most of the cost, they also assume most of the risk. Considering the amount of vacancy in other area apartments, I’m still curious as to the viability and actual need of the complex. Finally, why don’t you go to the Planning Commission meeting and spout your opinions. By all means, put your sentiments and true feelings about your neighbors and community on the public record. The power grid? Proffers? The water and sewer? Your concerned with power consumption? Gee, I just thought u were racist. I should of known u had u’re eye on that Stoner program at Dominion Power, monitoring that usage. And your concerning u’reself with the money Tommy Balzer has to pay to extend the water and sewer? Actually I think your oblivious to that. Soooo there’s that. Oh. And this camouflaged racist concern, “how much of the W&S will it consume?” Unreal. I’m sure Tommy is laughing. That is sofa king stupid. And by the way, what does an apartment building have to do with crime? It’s apparent you people have it earmarked for some type of people inferior to yourselves. And is it PC that tells us to “read the papers” concerning local crime? This paper good with u PC? Oh. Give me a break. This is 2011, not 1811. With the attitudes I see here, I would expect to see horse and wagons on the dirt trails of Powhatan. The sky does not fall every time someone wants to push Powhatan into the 21st century. Last time I checked, Powhatan was still part of the United States. Studies have proven that diversity is good for the community, the economy, and society in general. All renters are not thugs and druggies. At some point we were all newcomers to Powhatan.
