Man sentenced to serve jail time for fourth DIU in 10 years

Herbert Linthicum was arrested October 31, 2008 charged with driving under the influence.

According to the arresting officer, Linthicum was unresponsive at the wheel and asleep through two traffic light cycles.

Last week Linthicum, 50, pleaded guilty under a plea agreement and was ordered to serve one year in the penitentiary.

Linthicum was convicted of DUI in Chesterfield County in 2000, 2002 and 2006.

“You endanger everyone who uses these roads,” Warren told Linthicum last week. “This is not about drinking, it’s not a crusade against drinking. When you get behind the wheel of a car [drunk], you may as well be driving around shooting a revolver.”

Linthicum was sentenced to five years in prison with four suspended and ordered to pay a $2,500 fine with $1,500 suspended.

Get the drunks off the road…Innocent people die every day because drunks make the decision to get tanked and get behind the wheel..Lives are ruined, but not usually the drunk’s..They usually walk away unscathed…

Judge Warren is known for being a fair, unbiased judge…unless you want to do his job, or are capable of it, maybe not pass judgment on him??

Dear Anonymous,

Let’s set the record straight. If you think a person that has three previous DUI convictions and is convicted of a fourth should be on the streets must less allowed to drive; you sir are an idiot. I too am not pleased with Judge Warren in this case either but not for the reasons that you are. I would have liked him to have rejected the plea agreement, set the matter for trial by jury and then imposed the five year maximum that a jury would have delivered. If you have an example of those that you consider “higher ups” not being prosecuted please bring the example to this forum.

judge warren is an idiot they only prosicute who they want to prosicute if it is anyone that is higher up they let go
