Plea agreement in breaking and entering retrial

30-year-old Dayomic Smith was accused of breaking into and entering a county home January 17, 2007 and on July 28, 2009, at a retrial, Smith entered a no contest plea to the charges.

“We agree that going to trial would be a risky venture,” said Defense Attorney Steven D. Benjamin. He told the court the evidence in the case “could have been sufficient to find guilt.”

A plea agreement was accepted by the court and, according to the stipulations of the agreement Judge Tomas Warren sentenced Smith to five years in prison with all of the time suspended. He already served five months on the charge.

Its a shame that powhatan county,continues to be the most racist county in Va. Its a maybury town with one judge ,one prosecuter, one detective under one law kkk.This innocent man was minding his buisness , didnt harm anyone touch or take anything , was simply trying to get his dog off of someones property. the rest was made up and into what they wanted to believe ... its a shame ...
