Woodfin appears before judge

A judge Oct. 24 certified charges against a Powhatan County man accused of gunning down his uncle in a domestic dispute.

A grand jury will decide whether David Woodfin, 22, should stand trial on the charges of first-degree murder and use of a firearm in the Aug. 1 killing of Donald P. Malkemus, 49.

During a preliminary hearing yesterday in Powhatan General District Court, Jandelyn Onufer, a friend of Woodfin’s, testified that shortly after she and Woodfin pulled up to the home that Woodfin shared with his grandparents, his uncle pulled up in his pickup truck.

Onufer said she suggested that they go into the house but Woodfin declined, saying he did not want a confrontation with his uncle.

But Woodfin also didn’t want to leave the property, Onufer said. Shortly after that, Malkemus walked toward the car where she and Woodfin were standing.

“That’s when his uncle started hollering at him,” Onufer said. “He just said something about money.”

Malkemus then “went after David” and grabbed him by the throat, Onufer said.

“At one point it almost looked like he had him off the ground,” she said.

When Malkemus released Woodfin, he ran into the house and Malkemus got into his truck, Onufer said.

Woodfin came back out of the house armed with a rifle, Onufer said. “I saw him start shooting,” she said.

Onufer said she heard three shots. After the shooting stopped and Woodfin had run off, Onufer said she looked in the truck and saw Malkemus leaning back.

“He was kind of slumped over,” she said.

Meanwhile, on an unrelated charge, Judge Paul W. Cella convicted Woodfin of a misdemeanor charge of obstruction of justice and imposed a 30-day suspended sentence. A charge of failure to appear for an earlier hearing was dismissed.

The obstruction charge was brought after officers had to subdue Woodfin in June after he had inflicted several knife wounds on his arm.

Cpl. M.R. Baltimore said Woodfin briefly fled into the woods to avoid the officers and, after returning, made threatening comments to them. Baltimore said the officers had to use Mace on Woodfin as he tried to run.

But two of Woodfin’s sisters and a friend testified that the deputies used the Mace on Woodfin, beat him with batons and used a Taser as he was putting his hands out voluntarily to be cuffed.

Baltimore said the officers did not strike Woodfin and at the time did not even have Tasers.

These are the ONLY people Donald would be concerned with right now. It sadend me deaply to read these comments.

old timer no if hed have hurt david that would not have been okay no matter how I feel about someone I would not condone them hurting another human being!!!!!  For something as trivial as money.  However the fact remains that donald was in his truck and in the process of leaving the property so what david did was totaly uncalled for in my opinion.  I do not blame you for standing behind him, I two am a father so I understand that bond.

old timer people have a right to voice there opinion,you aired your dirty laundry for the whole of powhatan to see ,but you want everyone to agree with you. i dont think so ...it dosnt change the fact that a man was shot and KILLED
if you do not like the comments then you should think twice about putting all that crap in the paper,what did you really ,expect for us all to feel sorry for a murderer

rest in piece we all miss you every day buddy!!!  As for davids father I feel for you and I dont know what happened exactly I wasent there but I do know he took a very hard working honest and careing member of the community and the tree buiseness from us and a great dad from his kids!!!!!!!!!!!!  For this he deserves to pay the ultimate price!!!!!!!!!!!!!!!!!!  Donald taught me a lot my father was donalds football coach that should tell you how well and long Ive known donald I miss and love you brother!!!!!!!!!!!!!!!!!!!!!!!!r.i.p. you will never be forgotten good friend!!!!!!!!!!!!

Calm down old timer!  I was just reading the article and comments and it comes across as there was not a good relationship between the two; there was a fight - unfair fight - both parted ways and then one was shot and killed.  I do believe a person is innocent until proven guilty beyond a reasonable doubt.  When such a crime is committed, the person accused will be held accountable. There is always more to the story and I have no doubt there is a lot of info the rest of the community will never know or understand.  I feel for all involved.

Everyone have their own personal thoughts and opinions and we should respect that. Although in every situation there is a saying that we cannot judge someone until he or she is proven guilty.  Just my thought….
